Article 9-1. Competence of the authorized body in the field of fisheries, its departments with territorial subdivisions of the Law on the Protection, Reproduction and Use of Wildlife

Authorized body in the field of fisheries:

1) performs strategic, regulatory, implementation, and supervisory functions within its competence;

2) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, formulates a state policy in the field of protection, reproduction, and use of fish resources and other aquatic animals in in accordance with the current legislation of the Republic of Kazakhstan;

3) carries out coordination and methodological guidance of local executive bodies in the field of protection, reproduction and use of fish resources and other aquatic animals;

4) develops and approves regulatory legal acts in the field of protection, reproduction and use of fish resources and other aquatic animals in accordance with the legislation of the Republic of Kazakhstan;

5) develops and approves norms and regulations in the field of protection, reproduction and use of fish resources and other aquatic animals;

6) defines a list of requirements, the violation of which entails the use of rapid response measures, and also defines, in relation to specific violations of the requirements, a specific type of rapid response measure, indicating the duration of this measure (if necessary).

The list of requirements, the violation of which entails the use of rapid response measures, includes requirements that are subject to state control in accordance with Article 143 of the Entrepreneurial Code of the Republic of Kazakhstan.;

7) develops and approves a methodology for determining the rates of fees for the use of fish resources and other aquatic animals and the amount of compensation for damage caused by violation of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife, as well as calculating the amount of compensation for damage caused and inflicted on fish resources and other aquatic animals, including unavoidable, as a result of economic activity;

8) issues an opinion (authorization document) for the export of wild live animals (fish and other aquatic animals) from the customs territory of the Eurasian Economic Union, including rare and endangered animals included in the Unified List of Goods subject to prohibitions or restrictions on import or export by the member States of the Eurasian Economic Union in trade with third countries;

9) issues permits for the import into the territory of the Republic of Kazakhstan, export and (or) re-export from the territory of the Republic of Kazakhstan of species of fish and other aquatic animals subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

10) develops and approves the procedure for preparing a biological justification for the use of fish resources and other aquatic animals;

11) develops and approves a list of permitted commercial and non-commercial types of fishing gear and methods;

12) organizes and (or) ensures the conduct of scientific research and design and survey work in the field of protection, reproduction and use of fish resources and other aquatic animals in fisheries reservoirs located in two or more areas;

13) develops and approves the order of movement of water transport during the spawning period prohibited for fishing, as well as in reservoirs and (or) areas prohibited for fishing;

14) develops and approves the procedure for labeling caviar of sturgeon species for trade in domestic and foreign markets and the form of a stamp for trade in caviar of sturgeon species on the foreign market, and issues a stamp for trade in it on the domestic market;

15) carries out and (or) organizes fishing for the purpose of introduction, reintroduction and hybridization, fishing for reproductive purposes, fishing in hazardous reservoirs and (or) sites, and also carries out control fishing;

16) issues permits for the use of fish resources and other aquatic animals for the purposes of scientific research fishing in fishery reservoirs located in two or more regions, as well as for rare and endangered species of animals;

17) verifies the activities of users of wildlife (in terms of fish resources and other aquatic animals) in order to determine compliance with the requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife;

18) carries out state control and supervision in the field of protection, reproduction and use of wildlife in terms of fish resources and other aquatic animals;

19) on the basis of scientific recommendations, decides on reclamation fishing in cases of a threat of starvation, which will inevitably lead to the death of fish, and the impossibility of eliminating such a threat by conducting ongoing fisheries reclamation of water bodies or parts thereof.;

20) receives notifications on the commencement or termination of activities for the artificial breeding of animals (fish and other aquatic animals), the species of which are included in annexes I and II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

21) develops and approves the rules for carrying out work on the stocking of reservoirs, fisheries reclamation of water bodies;

22) develops and approves rules for the establishment of restrictions and prohibitions on the use of fish resources and other aquatic animals, their parts and derivatives;

23) develops and approves the rules for issuing permits by the administrative body for the import into the territory of the Republic of Kazakhstan, export and (or) re-export from the territory of the Republic of Kazakhstan of species of fish and other aquatic animals subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

24) develops and approves rules for the allocation of quotas for the seizure of fishing facilities;

25) develops and approves fishing regulations;

26) develops and approves the rules of fisheries management;

27) develops and approves rules for issuing permits for the use of fish resources and other aquatic animals;

28) decides on the introduction of restrictions and prohibitions on the use of fish resources and other aquatic animals, their parts and derivatives, establishes the places and terms of their use on the basis of a biological justification issued by relevant scientific organizations;

29) develops and approves the rules of the competition for the consolidation of fisheries reservoirs and (or) sites and the qualification requirements for the participants of the competition;

30) develops and approves rules for the maintenance, breeding in captivity and semi-captivity of rare and endangered species of fish and other aquatic animals, including those subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

31) organizes and ensures the reproduction and state accounting of fish resources and other aquatic animals in the reserve fund of fisheries reservoirs and (or) sites;

32) carries out state control and supervision over local executive bodies in the field of protection, reproduction and use of wildlife in terms of fish resources and other aquatic animals;

33) decides to postpone the ban on the withdrawal of fish resources and other aquatic animals for fifteen calendar days in one direction or another, depending on the natural and climatic conditions, without changing the total duration of the ban on the recommendation of accredited scientific organizations in the field of protection, reproduction and use of fish resources and other aquatic animals.;

34) conducts a competition for the consolidation of fisheries reservoirs and (or) sites of international, national and local importance;

35) develops and approves rules for the use of fish and other aquatic animals, except for rare and endangered ones, in order to prevent epizootics;

36) develops and approves rules for monitoring fish and other aquatic animals;

37) develops and approves rules for the transfer of fishery reservoirs and (or) areas designated for fishing to fisheries reservoirs and (or) areas for fish farming;

38) issues a license for the export of wild live animals (fish and other aquatic animals) from the customs territory of the Eurasian Economic Union, including rare and endangered animals included in the Unified List of Goods subject to prohibitions or restrictions on import or export by the member States of the Eurasian Economic Union in trade with third countries;

39) concludes contracts for the management of fisheries;

40) issues a permit for the use of fish resources and other aquatic animals for the purpose of fishing for aquatic biological resources in the fishing zone and the common water area;

41) makes decisions on securing and (or) extending the terms of securing fisheries reservoirs and (or) sites of international, national and local significance;

42) makes decisions on the transfer of fishery reservoirs and (or) areas designated for fishing to fisheries reservoirs and (or) areas for fish farming;

43) develops and approves requirements for fish protection devices for water intake and discharge facilities and coordinates their installation;

44) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The Agency and its territorial subdivisions carry out their activities within the competence established by the authorized body in the field of fisheries.

The Law of the Republic of Kazakhstan dated July 9, 2004 No. 593.

This Law regulates public relations in the field of protection, reproduction and use of wildlife, as well as the conservation and reproduction of Kazakh dog breeds and is aimed at ensuring conditions for the conservation of wildlife and its biological diversity, sustainable use of wildlife in order to meet environmental, economic, aesthetic and other human needs, taking into account the interests of present and future generations..
